Justice Binta Murtala-Nyako has been assigned to hear and stop the forthcoming local government election in Delta state due to what the plaintiff, DELTA STAKEHOLDERS GROUP (DSG) described as gross violation of the Electoral Act
In the Suit No. FHC/ABJ/CS/1118/2017 filed in the Federal High Court Abuja amongst others demand:
a. get a judicial declaration that the DSIEC Law is unconstitutional, null, void and of no effect whatsoever to the extent that it violates the Constitution and the Electoral Act (on the doctrine of ‘Covering the Field’ which forbids a State House of Assembly from making laws that are inconsistent with Acts duly enacted by the National Assembly);
b. restrain or prevent the Independent National Electoral Commission (INEC), Inspector-General of Police (IGP), Attorney-General of Delta State, Attorney-General of the Federation (AGF) and Director-General (DG) of the State Security Service (SSS) from taking any step in support of DSIEC’s implementation of the bad law. In this regard, we specifically seek, amongst others, to stop INEC from releasing its Voters Register to DSIEC to conduct the proposed Local Government elections and forbid the Nigerian Police and SSS from providing security for any LGA election founded on the bad law; and
c. sack anyone (Chairman or Councilor) who may be ‘elected’ or imposed on our people on the basis of the bad law.
