COURT RECOGNIZES EMERHOR&#8217;S FACTION"},"content":{"rendered":"<p><code><script async src=\"\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js\"><\/script><br \/>\n<!-- www.newsroom247.com.ng --><br \/>\n<ins class=\"adsbygoogle\" style=\"display: block;\" data-ad-client=\"ca-pub-2163942495525027\" data-ad-slot=\"1411897411\" data-ad-format=\"auto\"><\/ins><br \/>\n<script>\n(adsbygoogle = window.adsbygoogle || []).push({});\n<\/script><\/code><\/p>\n<div dir=\"auto\">A Delta State High Court sitting in the Kwale Judicial Division, presided over by Justice V.I Ofesi has\u00a0 affirmed Chief Cyril Ogodo led Delta APC Exco and restrained the\u00a0 National Working Committee, the National Chairman of the party, Mr. Adams Oshiomhole,\u00a0 the Independent National Electoral Commission\u00a0 from recognising or dealing with\u00a0 any other\u00a0 executives of the party in the state.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">It will be recalled that\u00a0Hon. Justice Chikere recently affirmed that only the valid delegates who emerged from the congresses conducted by Alhaji Dododo could produce a State Executive as was done on 19th May, 2018 when Prophet Jones Ode Erue and his entire State Executives were duly elected.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">However in today&#8217;s judgment, the presiding judge, Justice V.I Ofesi also granted an interim injunction restraining the party or its agents from swearing-in any other Ward and Local Government Areas Executives of the APC in the state order than the Chief Cyril Ogodo-led leadership which has been sworn-in and since assumed office before the emergence of the current NWC.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Joined in the case with suit no. HCK\/56\/2018 are the All Progressive Congress, Comrade Adams Oshiomole (The National Chairman, APC), Hon. Mai Mala Buni (National Secretary, APC) and the Independent National Electoral Commission (INEC) as defendants.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The plaintiffs; Emmanuel Kem Oki (State Welfare Secretary, APC), Mr. Amabiri Azorbo Paul (Chairman, Bomadi Local Govt. Area, APC), Chief Jiminyevwe Dicbame Ubu (Chairman, Ughelli South Local Govt. Area, APC) and Elder Lewis Odigwe (APC Chairman, Ndokwa West Local Govt. Area) had approached the court to restrained the defendants from recognising or dealing with any other faction except the Ogodo-led faction.<\/div>\n<div dir=\"auto\"><\/div>\n<p><iframe loading=\"lazy\" src=\"https:\/\/www.alternativeadvert.com\/show.php?z=30&amp;pl=16606&amp;ad_type=59&amp;rl=180\" width=\"300\" height=\"250\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<div dir=\"auto\">Ofesi after hearing from the counsel to the applicants, Chief F. I. Obigbor, the court ordered, \u201cI have considered all the processes filed in support of this motion especially paragraphs 5 \u2014 16 of the 1 8 paragraphs supporting affidavit- Exhibits A \u2014 E including the Counsel written address, I am of the view that in the interest of justice, this application be granted and it is hereby granted.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\u201cThe Order of Interim Injunction is hereby granted restraining the 1st &#8211; 3rd defendants whether by themselves, their agents, servants, or howsoever called from recognizing and\/or swearing in any other State Executive of the All Progressive Congress (APC), Delta State, apart from that chaired by Chief Cyril Abeye Ogodo and his members into office, pending the hearing and determination of the Motion on Notice for interlocutory injunction pending before this Court.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\u201cSecondly, an order of interim injunction is made restraining the 4th (INEC) whether by itself, its agents, servants or howsoever called from recognizing and\/or dealing with any other State Executive of the All Progressives Congress (APC), Delta State, apart from that chaired by Chief Cyril Abeye Ogodo and his members. pending the hearing and determination of the Motion on Notice already filed in this case before this Court.\u201d<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The judge also granted, \u201can order of interim injunction is hereby made restraining the defendants whether by themselves, their agents, servants or howsoever called from recognizing and\/or swearing in any other Ward and Local Government Areas Executives of the All Progressive Congress (APC) held on the 5th and 12th day of May2018 under the chairmanship of Hon. Emmanuel Chinda and approved by the National Working Committee same having been sworn in and assumed duty.
