H.E UHURU MUIGAI KENYATTA\u2026\u2026..\u2026\u2026..\u2026\u2026\u2026.3RD RESPONDENT<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">DETERMINATION OF PETITION WITHOUT REASONS<\/div>\n<div dir=\"auto\">(Pursuant to Rule 23(1) of the Supreme Court (Presidential Election Rules) 2017<\/div>\n<div dir=\"auto\"><\/div>\n<p><code><script async src=\"\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js\"><\/script><br \/>\n<!-- www.deltanewsroom.com --><br \/>\n<ins class=\"adsbygoogle\" style=\"display: block;\" data-ad-client=\"ca-pub-2163942495525027\" data-ad-slot=\"1411897411\" data-ad-format=\"auto\"><\/ins><br \/>\n<script>\n(adsbygoogle = window.adsbygoogle || []).push({});\n<\/script><\/code><\/p>\n<div dir=\"auto\">[1] The hearing of this Petition was concluded on Tuesday, 29th August 2017 well after\u00a0<span class=\"aBn\" tabindex=\"0\" data-term=\"goog_2106160927\"><span class=\"aQJ\">9.00 p.m.<\/span><\/span>\u00a0 The Judges thereafter retreated to deliberate on the following issues for determination as crafted by the court:<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">(i) Whether the 2017 Presidential Election was conducted in accordance with the principles laid down in the Constitution and the law relating to elections.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">(ii) Whether there were irregularities and illegalities committed in the conduct of the 2017 Presidential Election.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">(iii) If there were irregularities and illegalities, what was their impact, if any, on the integrity of the election?<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">(iv) What consequential orders, declarations and reliefs should this court grant, if any?<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">[2] Having carefully considered the above issues, the following is the majority decision of the court with two Judges (J.B Ojwang and N. S. Ndung\u2019u SCJJ) dissenting):<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><\/div>\n<p><iframe loading=\"lazy\" src=\"https:\/\/www.alternativeadvert.com\/show.php?z=30&amp;pl=14247&amp;ad_type=59&amp;rl=180\" width=\"300\" height=\"250\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<div dir=\"auto\">(i) As to whether the 2017 Presidential Election was conducted in accordance with the principles laid down in the Constitution and the law relating to elections, upon considering inter alia Articles 10, 38, 81 and 86 of the Constitution as well as, Sections 39(1C), 44, 44A and 83 of the Elections Act, the decision of the court is that the 1st Respondent failed, neglected or refused to conduct the Presidential Election in a manner consistent with the dictates of the Constitution and inter alia the Elections Act, Chapter 7 of the Laws of Kenya.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">(ii) As to whether there were irregularities and illegalities committed in the conduct of the 2017 Presidential Election, the court was satisfied that the 1st Respondent committed irregularities and illegalities inter alia, in the transmission of results, particulars and the substance of which will be given in the detailed and reasoned Judgment of the court.\u00a0 The court however found no evidence of misconduct on the part of the 3rd Respondent.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">(iii) As to whether the irregularities and illegalities affected the integrity of the election, the court was satisfied that they did and thereby impugning the integrity of the entire Presidential Election.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">[3] Consequent upon the above findings, and as to what orders, declarations and reliefs this court should grant, the following are the orders of the court pursuant to Article 140(2) and (3) of the Constitution and Rule 22 of the Supreme Court (Presidential Election) Rules:<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">(i) A declaration is hereby issued that the Presidential Election held on 8th August 2017 was not conducted in accordance with the Constitution and the applicable law rendering the declared result invalid, null and void;<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">(ii) A declaration is hereby issued that the 3rd Respondent was not validly declared as the President elect and that the declaration is invalid, null and void;<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">(iii) An order is hereby issued directing the 1st Respondent to organize and conduct a fresh Presidential Election in strict conformity with the Constitution and the applicable election laws\u00a0<span class=\"aBn\" tabindex=\"0\" data-term=\"goog_2106160928\"><span class=\"aQJ\">within 60 days<\/span><\/span>\u00a0of this determination under Article 140(3) of the Constitution.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">(iv) Regarding costs, each party shall bear its own costs.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">[4] A detailed Judgment containing the reasons for this decision and the dissents will be issued\u00a0<span class=\"aBn\" tabindex=\"0\" data-term=\"goog_2106160929\"><span class=\"aQJ\">within 21 days<\/span><\/span>\u00a0of this determination in conformity with Rule 23(1) of the Supreme Court (Presidential Elections) Rules, 2017 as it is otherwise impossible with the limited time the court has, to do so.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">[5] It is so ordered.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">DATED and DELIVERED at NAIROBI this 1st Day of September, 2017<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\"><a href=\"http:\/\/newsroom247.com.ng\/wp-content\/uploads\/2017\/09\/KENAYA-ELECTION.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-15716\" src=\"http:\/\/newsroom247.com.ng\/wp-content\/uploads\/2017\/09\/KENAYA-ELECTION-300x168.jpg\" alt=\"\" width=\"300\" height=\"168\" srcset=\"http:\/\/newsroom247.com.ng\/wp-content\/uploads\/2017\/09\/KENAYA-ELECTION-300x168.jpg 300w, http:\/\/newsroom247.com.ng\/wp-content\/uploads\/2017\/09\/KENAYA-ELECTION-768x431.jpg 768w, http:\/\/newsroom247.com.ng\/wp-content\/uploads\/2017\/09\/KENAYA-ELECTION.jpg 780w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026.. \u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026<\/div>\n<div dir=\"auto\">\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0D.
