Akwa Ibom state, has restrained<br \/>\nthe University of Calabar from fielding anyone as bursar of the<br \/>\nUniversity, pending the determination of the motion on notice before<br \/>\nit.<br \/>\nThe former bursar of the University, Mr. Peter Agi (claimant) was in a<br \/>\ncontroversial circumstance suspended in August and eventually sacked<br \/>\nby the management\u00a0 in November last year over<br \/>\nallegations of fraud and other.<br \/>\nHe however dragged the school, the Vice<br \/>\nChancellor and the Registrar to court seeking redress insisting that<br \/>\ndue process was not followed.<\/p>\n<p><code><iframe loading=\"lazy\" src=\"https:\/\/www.alternativeadvert.com\/show.php?z=30&amp;pl=12164&amp;ad_type=59&amp;rl=180\" width=\"300\" height=\"250\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/code><\/p>\n<p>Agi lost the matter in the Industrial court in Calabar on Tuesday last<br \/>\nweek but proceeded to the Industrial Court in Uyo on 23 January, 2017,<br \/>\nthrough his counsels\u00a0 Chidimma Nancy Nwajiobi and Michael Nkwan with<br \/>\nan expert application for an interlocutory injunction restraining the<br \/>\nrespondent (University of Calabar and two others) from interviewing or<br \/>\nemploying any person or persons in place of the claimant\/applicant as<br \/>\nBursar of the University of Calabar pending the determination of<br \/>\nmotion or notice filed and served on the respondent.<\/p>\n<p>Upon hearing the affidavit of urgency in the support of the interim<br \/>\ninjunction sworn to by Agi and submissions from his counsels, the<br \/>\ncourt in an injunction signed by the Registrar, Mr. Peter Ortese and<br \/>\ndated January 24, ordered \u201can interim injunction restraining the<br \/>\nrespondents from interviewing or employing any persons or persons in<br \/>\nplace of the claimant as Bursar of the University of Calabar is hereby<br \/>\ngranted pending the determination of the motion on the notice for<br \/>\ninterlocutory injunction\u201d.<\/p>\n<p>Accordingly, the court adjourned the motion on notice to be heard on<br \/>\nthe <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_998714337\"><span class=\"aQJ\">31 January, 2017<\/span><\/span>.<\/p>\n<p>It is recalled that National Industrial Court in Calabar had dismissed<br \/>\nthe suit filed by<br \/>\nAgi, challenging his suspension and eventual sack saying he did not exhaust<br \/>\ninternal processes.<\/p>\n<p>Ruling on the matter in Calabar on\u00a0 last week, Justice Nneka\u00a0 Esowe said Agi\u2019s suit was premature, having failed to comply with the internal<br \/>\ndispute mechanisms as stipulated by University of Calabar Law no. 80<br \/>\nof 1979 and that Agi did not exhaust internal processes before coming to<br \/>\ncourt and it was difficult for his prayers to stand.<\/p>\n<p>Speaking on the ruling, Counsel to the Vice Chancellor, Abiye<br \/>\nAtururobibo, said, \u201cwe are happy that the court has done justice in<br \/>\nthis matter and has completely venerated our position which we always<br \/>\ncanvassed from the inception of this matter that Mr Peter Agi\u2019s action<br \/>\nagainst the University is incompetent and premature because he did not<br \/>\nfollow due process&#8221;.<\/p>\n<p><script async
